i just got a '01 explorer from a dealer less than a month ago, two days ago i rolled it, now its totaled. i only have LIABILITY insurance, and the insurance company said i have to pay off the rest of the car, which i expected, but when i called the dealer she said she might be able to count the car as a total loss, and get me in another car from them, without paying for the old one anymore. she is going to let me know in a couple days if they can. is this possible to just somehow avoid all the payments on the old car and start over new? are they scared i would end up not paying them for a car i dont have, so they somehow write it off and start a new payment plan on a whole new car? When I was in college I was in a relationship that made me really depressed, and the psychologist on campus referred me to an outside therapist with a diagnosis of major depression --the outside therapist corrected it and said she believed i had circumstantially-related depression, but she told me she coded the claim with the referring guy's major depression label so the insurance company wouldn't hassle me about the paying the claim. I worked with her for a 6 months --no medication, just got out the relationship--and am happy and healthy :) Now I'm reading all kinds of scary stuff about MIB, retroactive declining of coverage, etc and I currently have new individual (underwritten) coverage--I can ask her to correct the claim with my old company, but it seems like any action might rock the boat and I'm scared--if they didn't notice it, should i leave it be? or is there a chance that if i (god forbid) get something serious down the road that my current insurer will dig up my records from my old insurer to look for a reason to not pay? she was trying to do something to make my life easier but this whole thing has turned into such a mess!

AAA insurance will only pay body shop?

Hi there, My mom was rear ended by an uninsured motorist while driving my car. I have uninsured motorist coverage and AAA estimated the damage to be approximately $1000. I own my car (it's paid off) and I would rather buy the bumper and someone I know replace the bumper, rather than go to the body shop of AAA's choice. AAA does not want to give me a check and is saying they want to pay a body shop to do it. Can they do this? I looked at my policy and it doesn't say anywhere that repair costs are to be paid to a body shop, rather than the car owner or driver. I certainly don't have anything signed that says that and there is nothing in my policy details. Thanks for your help!
